Effective date: November 1, 2026. Last updated: November 1, 2026.
These Terms of Use ("Terms") are an agreement between you and ZivOwn Technologies Inc. ("ZivOwn," "we," "us"). They cover your use of zivown.com and the ZivOwn platform (the "Platform"). By creating an account or using the Platform, you agree to these Terms and confirm you have read our Privacy Policy. If you don't agree, please don't use the Platform.
1. What ZivOwn is, and is not
ZivOwn is an information and matching service for homebuyers. We help you understand your homebuying readiness, discover programs that may fit your profile, and connect with licensed real estate agents and lenders.
ZivOwn is not a lender, mortgage broker, real estate brokerage, or investment adviser. We do not make loans, take loan applications, approve or deny loans, set rates or loan terms, or represent you in a real estate transaction. Any loan is between you and the lender you choose. Any real estate representation is between you and the agent you choose.
2. ZivOwn is in beta
ZivOwn is in beta. Features may change, and you may see occasional errors or times when the Platform is unavailable. We'll do our best to fix problems quickly, and we welcome your feedback at contact@zivown.com.
3. Who can use ZivOwn
You must be 18 or older and able to enter into a binding agreement. You agree to give accurate information, keep your password private, and let us know right away if you think someone else has used your account. You're responsible for activity in your account.
4. Your ZivScore™ and program information
- Your ZivScore is an educational readiness score based only on the information you provide. It is not a credit score, credit decision, loan approval, pre-qualification, or pre-approval. Only you can see it.
- ZivOwn never pulls your credit. A lender pulls your credit only after you choose to apply with them and give them permission.
- Program information (including down payment assistance) comes from public sources and is for education only. Programs can change, pause, or run out of funds at any time. Your lender confirms final figures and program requirements at loan approval. A down payment assistance match is not a funding guarantee.
5. Contract Reader, Inspection Reader, and other tools
Contract Reader, Inspection Reader, the contract timeline, and other tools are for information only. They may miss or misread something. They are not legal, financial, tax, or inspection advice, and they don't replace your agent, lender, inspector, attorney, or other professional. Always confirm dates, deadlines, and details with your agent, lender, or inspector. You are responsible for meeting the deadlines in your contract.
6. Agents and lenders
How we're paid. ZivOwn receives a flat subscription or license fee from the agents and lenders on our Platform. The fee is the same no matter how many buyers they're matched with, whether you work with them, or whether you buy a home. ZivOwn doesn't receive any part of an agent's commission or a lender's fees, and no one can pay for a higher spot or to be shown more often.
Your choice. Agents and lenders are matched to you by the area they serve and the products and programs they offer. In some areas, one licensed lender serves the area right now. You never have to use any agent or lender we show you, and you can bring your own.
They're independent. Agents and lenders are independent businesses, not ZivOwn employees or agents. We verify their licenses (DRE or NMLS) before any buyer match, but we don't supervise their services, advice, rates, fees, or decisions, and we aren't responsible for them. Your relationship with any agent or lender is directly with them.
ZivOwn's founder is a licensed California real estate broker. Her brokerage is not on the ZivOwn Platform and does not receive buyers through it.
7. Sharing your information
We share your information with an agent or lender only after you give permission through our Consent to Share for that provider. You choose what to share, and you can revoke permission any time in Settings → Privacy & data rights. Our Privacy Policy and GLBA Privacy Notice explain how we handle your information.
8. Texts, calls, and emails
We send account and service messages by email. We call or text you only if you agree to it, and that consent is never required to use ZivOwn. Reply STOP to any text to opt out. You can turn off program alerts any time in your settings.
9. Content you upload
You keep ownership of the documents, messages, and other content you upload. You give ZivOwn permission to store, process, and display that content only to run the Platform for you, including reading your documents with our tools and delivering them to the people you choose. You confirm you have the right to upload what you upload.
10. Rules for using ZivOwn
You agree not to:
- Give false information or use someone else's identity or account
- Use the Platform for anything illegal, harassing, or discriminatory
- Upload malware, or try to break into, overload, or disrupt the Platform
- Copy, scrape, resell, reverse engineer, or build a competing product from the Platform
- Upload content that infringes someone else's rights
We may suspend or close an account that breaks these rules.
11. Copyright complaints
If you believe content on ZivOwn infringes your copyright, send a notice to our Copyright Agent with: your contact information; a description of the work; where the content appears on ZivOwn; a statement that you believe in good faith the use isn't authorized; a statement, under penalty of perjury, that your notice is accurate and you're authorized to act for the owner; and your signature.

We remove content when we receive a valid notice and let the person who posted it know. They can send a counter-notice if they believe it was removed by mistake. We close the accounts of repeat infringers.
12. ZivOwn's property
ZivOwn owns the Platform, its software and design, the ZivScore methodology, and the ZIVOWN name and logo, including patent-pending technology. We give you a personal, limited right to use the Platform under these Terms. Nothing else is licensed to you.
13. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, ZIVOWN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't promise that you'll qualify for any loan or program, buy a home, or reach any particular outcome, or that the Platform will be error-free or always available.
14. Limitation of liability
To the fullest extent the law allows, ZivOwn is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities, arising from your use of the Platform or from any agent's or lender's services. ZivOwn's total liability to you for any claim is limited to $100. Some states don't allow these limits, so they may not all apply to you.
15. Ending your account
You can delete your account any time in your account settings. We may suspend or close accounts that break these Terms, or stop offering the Platform, with notice where we can. Sections 9 (your permission ends when your content is deleted) and 12 through 17 continue after your account ends.
16. Governing law and arbitration
Please read this section carefully. It affects how disputes are resolved.
Governing law. These Terms are governed by the Federal Arbitration Act and, otherwise, by California law.
Try to resolve it first. Before starting arbitration, please email contact@zivown.com with a description of the issue. We'll each try in good faith to resolve it within 30 days.
Binding individual arbitration. If we can't resolve it, any dispute between you and ZivOwn about the Platform or these Terms will be decided by binding arbitration, not in court, except as listed below. The American Arbitration Association (AAA) will run the arbitration under its Consumer Arbitration Rules, before one neutral arbitrator. Hearings can be held by video or phone, or in person in Placer County, California, or the county where you live. The arbitrator can award the same individual relief a court could.
Fees. If you start arbitration, you pay no more than the filing fee you would pay to file in court. ZivOwn pays the rest of the AAA's fees and the arbitrator's fees, as the AAA rules and California law require.
Individual claims only. You and ZivOwn each bring claims only on an individual basis, not as a plaintiff or class member in any class, group, or representative action.
What's not covered. Either of us may bring a qualifying claim in small claims court. Either of us may go to court to stop misuse of intellectual property. Nothing here waives your right to seek public injunctive relief under California law; a claim for that relief will go to court after the arbitration of any other claims.
Your right to opt out. You can opt out of this arbitration agreement within 30 days of creating your account by emailing contact@zivown.com with your name, account email, and a statement that you opt out of arbitration. Opting out won't affect anything else in these Terms. If you opt out, disputes will be handled in the state or federal courts in Placer County, California.
If part of this section is invalid. If the class action waiver is found unenforceable for a claim, that claim goes to court, not arbitration. If any other part of this section is found unenforceable, the rest still applies.
17. Changes to these Terms
We'll post any changes here and update the date at the top. If a change is material, we'll notify you by email or in the Platform before it takes effect, and you'll be asked to agree again at your next sign-in.
